You agree to these terms by making a donation

These rules and regulations (“Terms and Conditions ” ) shall be binding on each participant (“Donor” and/or “You”) for the worldwide territory (“Territory”) who voluntarily desire to make monetary donations to Supervasi Foundation ("Supervasi").

Any information gathered through this Terms and Conditions shall be subject to our Privacy Policy at available on our website.

If you do not agree to be bound or cannot comply with any of the Terms and Conditions or the Privacy Policy, please do not continue with the donation towards Supervasi. Your act of making the donation shall be deemed as your unconditional agreement and acceptance to the Terms and Conditions and the Privacy Policy.

This document is an electronic record in terms of Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

How can payments of donations be made?

Donations are currently accepted only from Indian citizens and/or organizations ("Donors"), residing inside or outside India. Donations can be made offline via bank transfer/cheque/DD to the bank account of Supervasi or online via our payment gateway(s). Bank account details of Supervasi can be obtained from our website at www.supervasi.org ("Website") under the respective section. Online payment can also be made from within the respective section of our Website.

How will the receipt of donation be sent?

Within 7 working days of realization of the donated amount, Supervasi will send a recipt of the donation to the Donor. For donations made from within India, the receipt will be sent in hardcopy (via mail) and softcopy (via email). For Donors outside India, only a softcopy of the recepit will be sent via email.

Can donors get a refund?

In case of an erroneous deduction, double transaction, or If the Donor wants to cancel the donation, Supervasi will refund the wrongly deduced amount within 3 working days from the date of making the donation. We would require a proof of deduction of the donation amount and a written communication for refund from the donor. Transaction charges may apply and will be borne by the Donor.

If the Donor cancels the transaction in the middle of the payment process and the amount is debited from the Donors account but not recieved by Supervasi, we are not responsible for refunding the said amount. The Donor must contact his/her banker to recover the funds.

Who is eligible for donations?

The Donor is eligible to make a donation, subject to these Terms and Conditions if:

Individial Donors :

The Donor is 18 years of age or above

Organization Donors :

The Donor is a company/proprietorship or any other entity duly registered/incorporated under the laws of India.

Liability for Online Payments

You understand and agree that in addition to these Terms and Conditions, the Donor shall also be bound by the terms and conditions of the Bank Website and/or any additional payment gateway service provider while making online donations.

You also understands and agree that the personal or sensitive personal information provided by the Donor on such third party websites shall be subject to the terms of such third party websites and Supervasi shall not be liable for the same.

Liability for Technical Failures

In case of any technical/network failure/disruption in accessing our Website or payment gateway, Supervasi reserves the right to at its sole discretion to cease accepting donations from Donors, in any manner as it may deem fit and necessary.

Liability for Dispute Resolution

Supervasi shall not be liable and/or responsible in any manner whatsoever in the event of any malfunction/fault /failure/disruption while making online donations via our payment gateway(s).

Any dispute in connection to the above shall be settled between the Donor and the Bank/Payment Gateway directly, without involving Supervasi in any manner whatsoever.

Supervasi shall not be responsible in the event Donations are not processed and /or received due to any technical error of any nature whatsoever.

Liability for Personal Information

Your donation through any means may result in certain instances of sharing of your personal information including but not limited to your phone number, name, PAN, credit and/or debit card (“Personal Information”). By donating the Donor is consenting to the use of such information, as governed by this Terms and Conditions, by Supervasi or by the service providers for accepting the donation, news and information, analytics, statistics, announcing the donation on our Website.

Supervasi will not sell the Donor’s personal information at any time to any third party. You agree and acknowledge that Supervasi will not be responsible for any actions of any third party including any service provider with regard to Personal Information.

Liability for Injury

Supervasi is in no manner whatsoever responsible and/or shall not be held liable in any manner whatsoever, for any injury, mental trauma, or other physical or mental issues caused to the Donor in any manner whatsoever or for any reason whatsoever in connection to the donation, payment gateway or the Website.

The Donor(s) shall hold harmless Supervasi, our Website, our volunteers, affiliates, officers, directors or any other person from and against any injury/damage/harm/loss/ death/ mental or emotional trauma suffered by the Donor(s), in any manner whatsoever in connection with the donation and waives all rights to file in person/ through any family member and/or third party any applications, criminal and/or civil proceedings in any courts or forum in India to claim any damages or reliefs, to the extent permissible under law.

Responsibility for Taxes

Supervasi shall not be responsible to pay for any taxes, duties, charges, license fees, insurance, levies etc. applicable under the laws of India, in relation to the donations and the same, if applicable, shall be solely borne by the Donor.

Responsibility for Cooperation

If required, the Donor agrees that he/she shall make himself/herself available from time to time and co-operate with Supervasi to participate in any activity and/or campaign, of any nature whatsoever which includes but is not limited to videos, pictures, interviews with the media etc, without any compensation payable to the Donor(s).

The Donor(s) agrees, allows, grants and permits Supervasi to record and/or make footage of such activities as specified herein on film, tape, or digital or other electronic media.

Ownership for Footage

In consideration of being afforded an opportunity to participate in Supervasi activities and make donations, the Donor(s) agrees that the footage of any nature with regard to the Donor(s) shall vest with Supervasi, including but not limited to all intellectual property rights and any other rights for worldwide and in perpetuity.

Supervasi may use the same in any manner and in any media whatsoever at any time throughout the world, without any consideration being payable to and/or being demanded by the Donor.

Third Party Sites

While making donation(s), the Donor may be provided with opportunities, links or other opportunities to use certain sites, services, products, applications or content offered by third parties. Your use of any Third-Party Services is subject to any terms of service or conditions of use associated with the Third-Party Services.

Supervasi does not control Third-Party Services and is not responsible for any Third-Party Services or for the contents thereof, including, without limitation, any links that may be contained in or accessible through Third-Party Services. Supervasi does not endorse any Third-Party Services or any products, content or communications linked to or accessible from the Services.

Donor agrees that the Donor is wholly responsible for making his/her own independent judgment regarding Donor’s user or interaction with Third-Party Services.

Third Party Links

If our Website provides links to other websites or destinations, the Donor should not infer or assume that Supervasi operates, controls, or is otherwise connected with these other websites or destinations. When the Donor clicks on a link on our Website, Supervasi will not warn the Donor that the Donor has left our Website and is subject to the terms and conditions (including privacy policies) of another website or destination.

Forfeit of Donation

Supervasi reserves the right to forfeit any Donation made by a Donor in the event it is found that any information provided by the Donor(s) is inaccurate, wrong, fraudulent or any misrepresentation is made by the Donor(s) and/or the Donor is in breach of any of the provisions of this Terms and Conditions.

Divisibilty of Document

The Donor acknowledges that in case any portion/clause of these Terms and Conditions is deemed invalid or becomes unenforceable or prohibited by the law of the country, such portions shall be considered divisible and shall not be part of the consideration, and the remainder of these Terms and Conditions shall be valid and binding and of like effect as though such provision was not included herein.

Legal Arbitration

Notwithstanding the conflict of laws principle, these Terms and Conditions shall be construed and governed in accordance with the laws of India and incase of any dispute or other matter arising in reference to the donation shall be referred to a sole arbitrator appointed by Supervasi and shall be governed by the Arbitration and Conciliation Act, 1996, amended from time to time.

The venue for arbitration shall be Mumbai, and the proceedings shall be conducted in English language. All the costs, charges and expenses in connection to the Arbitration shall be solely borne by the Donor (s) who has raised the dispute. The arbitrator’s award shall be substantiated in writing and shall be binding on the Donor(s).

Subject to the provision of Clause 21 above, the Courts having jurisdiction under the provisions of the Arbitration and Conciliation Act, 1996, to determine all matters which the Court is entitled to determine under the Act, including, without limitation, provision of interim relief’s under the provisions of Section 9 of the Arbitration and Conciliation Act, 1996, shall exclusively be the courts at Mumbai, India.

All Rights Reserved

Supervasi reserves all rights to make amendments to the existing Terms and Conditions in any manner without giving prior notice. Supervasi will update the modified date on the top of the page, whenever the Terms and Conditions are changed. It shall be the sole responsibility of the viewer(s)/Donor(s) to check the Terms and Conditions on our Website from time to time.

Supervasi reserves all rights to change the payment mechanism as it may deem fit in its sole and absolute discretion.

Supervasi reserves all rights to use the donation in any manner it deems necesarry during the timelines set by Supervasi, and in no event shall the Donor dispute the decision made by Supervasi in connection to the donation.
